摘 要 证人拒证权是指证人有拒绝对其所知道的案件事实作证的权利。它是一种免证的特权，是现代法治国家对证人作证义务的一项法定免除，是指特定范围的证人，基于其特定的身份，依法享有的拒绝承担证明责任的权利，或者免除其作证义务的权利。在我国，现行民事诉讼证人制度包括证人资格制度、证人权利义务制度和证人作证程序等制度却不甚完备，我国目前没有一部法律是承认证人有拒证的权利的，相反地，大部分的法律都规定了所有证人都具有作证的义务。有关证据的法律规定散见于三大诉讼法中以及法院的司法解释。我国目前没有证人拒证权制度的法律法规，通过证人拒证权的历史渊源、价值并结合我国在诉讼程序中证人拒证权制度的重要性来提出构建我国证人拒证权制度的具体建议。
