9.3.8 Condition of Approval: The Planning Commission may require reasonable conditions in conjunction with the approval of a Conditional Use Permit. Such conditions may include conditions necessary to insure that public services and facilities affected will be capable of accommodating increased service and facility loads caused by the proposed land use or activity, to protect the natural environment and conserve natural resources and energy, to insure compatibility with adjacent uses of land, and to promote the use of land in a socially and economically desirable manner. The conditions imposed shall be recorded in the minutes of the Township Planning Commission, and shall remain unchanged except upon mutual consent of a majority of the full membership of the Planning Commission and the owner of the property affected. The Planning Commission shall record in its minutes any changes in conditions of approval of Conditional Use Permits.
9.3.9 Requirements for Reasonable Conditions of Approval: Conditions of approval imposed upon Conditional Use Permits shall:
Be designed to protect natural resources, the health, safety and welfare, as well as the social and economic well-being of
1. Those who will use the land or undertake the activity being considered;
2. Residents and landowners adjacent and nearby the proposed land use or activity; [As amended 2-13-89]
3 . The community as a whole;
Be related to the valid exercise of the police power and to the proposed use or activity; and
Be necessary to meet the intent and purpose of the zoning requirements; be related to the standards established in this Ordinance for the land use or activity under consideration; and be necessary to insure compliance with those standards.
SECTION 9.4 EXISTING CONDITIONAL USE PERMITS
There are certain existing conditional use permits in the Township which were granted and effective as Special Use Permits under the Clinton County Rural Zoning Ordinance prior to the adoption of this Ordinance.
9.4.1 Special Use Permits in Existence Prior to This Ordinance: In the deliberations leading to the adoption of this Ordinance, it has been recognized that several Special Use Permits were granted under the Clinton County Rural Zoning Ordinance. The existence of such uses implies the desire of the owners of such property to continue the uses. Accordingly, the Township has constructed and treated the existence and implicit desire to continue the uses as applications for approval as continued Special Use Permits, or, known under this Ordinance, Conditional Use Permits. In lieu of the customary application procedure, the application shall be deemed to be the special use itself, as constructed and/or operated consistent with the special Use Permit granted by the County.
